Want to Get Emancipated but Parents Standing in My Way
My question involves juvenile law in the State of: California
I am 15 1/2 and I want to get emancipated. I was adopted by these people when I was 8. I was court declared with PTSD and depression. My parents are overall okay parents. They do have hurt me but they haven't left marks. When they get mad at me they say that they could say things to me that would damage me mentally... is that emotional abuse? Well we are going to family therapy but its not working.... They said they will not let me get a work permit when I am 16.... If I am gone for more than an hour without their permission they call the cops and they cops return me to my house. But I desperately want to leave. My grades are shitty and if I live on my own I could defiantly get good grades and support myself. But they will not let me work, and wont let me live away from the house... So how can I get emancipated?

A court "declared" you had PTSD??? How did THAT come about???
I presume that the PTSD was the result of actions taken by others before this couple adopted you?

Okaaaay ... yes, parents are allowed to discipline their children - they can even utilize corporal punishment. If you are being beaten, call the police or CPS ... but, I suspect that's not what's happening, is it?

Is it "emotional abuse" for them to tell you that they COULD say hurtful things if they wanted to??? Maybe. But, it doesn't seem to be unlawful.

Not working for who? Therapy works when you want it to. When the parties (you, them) do not allow it to work, it won't. And if the parties have unreal expectations, that will also stand in the way. If you want what you want and not getting what you want means it's not working, then it never will.

That's their choice. We are not letting my youngest son get his work permit at 16, either. He needs to focus on school this year. Maybe at the end of the school year for the summer, but, not yet. Your parents may have valid reasons for not wanting you to work just now. It might have something to do with your PTSD and whatever other issues you might have.

That is EASY to resolve: Don't leave without their permission!
This may also be part of the reason that they are not going to approve of a work permit. It may also be why there are problems. Remember, you are a minor and you are their responsibility. They do NOT have to let you go where you want when you want to go. And, right now, you have to take care of school. If you do what you are supposed to do, do well in school, follow their rules, and behave appropriately, I think you will find the reins loosened.

What on EARTH makes you think that your grades would get BETTER if you had to work full time AND go to school AND pay bills AND be responsible for yourself???? If you can't get good grades when you only have to worry about paying attention in calss, it makes no sense that adding to your real and emotional burden would improve your grades!

You will not be emancipated based on what you have written here.
