Can Out-of-State Relatives Get Guardianship of Minor Children
My question involves guardianship in the State of: Oklahoma with relatives wanting guardianship in Arkansas. Can Oklahoma court give relatives out-of-state guardianship of minors? They are 4&6. Both parents in jail for meth. The grandmother currently has the girls and they are homeless living in a tent. All are on meth. DHS states they can't do a drug test unless they see the drugs themselves. The oldest is not enrolled in school yet, already missed 2 days.
Re: Out of State Guardianship
Yes, that can happen.
But why haven't they been placed in an appropriate setting?

Have protective proceedings been commenced?

The grandmother has temporary guardianship by a signed piece of paper by the mother. DHS told us that it is not illegal to live in a tent as long as there is bottled water and food there. We talked with a lawyer Friday and she's looking into whether we can be guardians since we live out of state.

Then you should probably ask the attorney and go from there.

There's a variety of articles on Oklahoma guardianship at the Oklahoma Legal Aid website. Might be something helpful in there.

Beyond that, talk to the lawyer.
