Excessive Charges for Repainting a Room
My question involves landlord-tenant law in the State of: Florida
Hello, My ex-landlord is saying to paint a one bedroom apartment that I did smoke cigarettes in will cost 1200$$. meaning he's keeping my 800.00 and I will owe him 400.00 how can he do this to me and what steps to I need to take to fight this?

Did your lease forbid smoking inside of your unit?
Did you smoke to the point that there's nicotine staining on the walls?

$1200.00 to paint one room is excessive in any scenario. It could even be a bit high for painting an entire house, depending on the size of the house.

Not one room -- a one-bedroom apartment.
It is possible for smoke and nicotine staining to pervade a residence to the point that you have to paint the entire unit with a sealant before you apply a finish coat.

It still doesn't cost that much...particularly for a one bedroom apt.
3 gallons of sealant at 50.00 each and maybe 3 gallons of paint at 25.00 each add in 50.00 in misc stuff, total of $275.00 for materials.
At the most 16 hours of labor even at 25.00 an hour, 675.00 tops...and that is on the high end. You could even throw in another couple of gallons of sealant and paint and still just barely top 800.00, let alone get to 1200.00.

Absent a lease condition to the contrary or a law against smoking in ones residence ...I would think this is a matter of wear and tear ..and NOT deductible . Smoking is an ordinary event......
As a LL I know it's a pain to address smoke ...but never once did I think I could get it past the judge as "damages"

Before I'm going to obsess over the amount of the charge, I'm interested in learning enough facts to know if there is a basis for claiming that this is damage.
