    Filing Charges for a Break-In After More than a Year
    My question involves criminal law for the state of: Ohio
    Over one year ago, my home was broken into and family members threatened by the husband of a women involved in an affair with another family member. This woman filed charges of assault against said family member, who settled, and case is closed.
    No charges of B&E and harassment were brought against husband. Statute is still open and am looking for thoughts on proceeding with filing charges.

    You can't "file charges." You can certainly make a complaint, but with the passage of time the state is less likely to pursue them/

    Ditto flyingron's assessment. After more than a year, the police may still take a report (assuming the act is still within the statute of limitations to initiate prosecution), but a prosecutor is not all that likely to pursue the matter. If it was not worth the victim's time a year ago, it's not likely to be seen as worth the prosecutor's time today.

    But, the victim(s) can report the act and see where it goes.
