If One Spouse Files Bankruptcy During Divorce, Are Both Spouses Discharged from Debt
My question involves a marriage in the state of: GEORGIA
I am currently in the middle of divorcing my spouse(Husband). Our home is facing foreclosure. He filed Ch. 7 bankruptcy, (independently) unknown to me. He included jointly owned property- the current home and rental property, in his Bankruptcy. He was granted a discharge from his creditors, on 7/28/15. However, the home mortgage company has proceeded with foreclosure. Where does this leaves me as a co-borrower? Am I discharged from my debt obligations as it relates to the jointly owned home and rental property.
What steps should I take to protect my assets?
