    The police will accumulate whatever evidence they can get, including any witness statements, compile a police report, and submit it to a prosecutor. The prosecutor will then decide what, if any, charges should be brought.

    If all they have are witness statements and I deny it and the guy denies it would they have a case?
    My dad went to the police this morning and I'm worried. :wallbang: :eek: :( :(

    I'm really worried... i need advice on what to do when and if the police come to my house... my dad just spoke with the police today about an hour ago on his way to work.

    Consult with a criminal defense Attorney and have him present during questioning.

    depends on how they were deleted. if you right garbage over the deleted sector of the hard disk and delete, lather, rinse, repeat, the files are unrecoverable. Easily done automatically with a program like shredder.

    The problem here is that you are younger than your boyfriend. So the police may decide that you were corrupted by the older boyfriend. The sending of nude pictures of each other by their selves is not illegal, and let me clarify that. The picture must show you in a sexually suggestive way or you engaged in some type of sexual contact. The Supreme Court of the United States made the ruling. Otherwise that cute little picture your mama has of you when you were four years old in the bath tub would be illegal. I am surprised the police did not confiscate your computers for evidence. You can delete the pictures but that will not delete the hard drives. If like you said these were just pics of you and him naked, it wasn't smart but it also doesn't rise to the level of culpability.

    Ah yes... The infamous 16-year-old baby in a bathtub shot.... :rolleyes: The original post indicated that the pictures were suggestive, and this is way outside of the scope of the "baby in a bathtub". You have to be more careful, as you're not as familiar with the laws as you believe yourself to be.

    Your right Aaron. What I should have said is different jurisdictions will view the photos with the standard that their community and the law accepts. I just hope that a prosecutor would be able to realize the age of these children ascertaining that child pornography was not their intent. And not file charges that would ruin the rest of their lives.
