Theft Charges for Using a Parent's Debit Card
My question involves juvenile law in the State of: Washington.
Hello, I am in a sort of predicament with my parents.
A couple weeks ago I wanted to pay my phone bill of $45.00 plus tax online. Since I only have cash, I used my mothers HAPO debit card with the intent of paying her back the same day (I had to get the money from my boyfriend). Well, somehow she got a notification instantly and so my parents went up to my room and started screaming that I stole from them, then proceeded to push me to the ground and hit and kick me (legally, open hand unfortunately and no bruises) while the other parent began to tear apart my room looking for my phone (which I skillfully hid). They took off in the car to consult my boyfriend's parents in the whole ordeal, and while they were gone I got $50 and placed it on the table for them before running off for a couple minutes with my boyfriend. When I came back, they locked me out of the house in nearly 100 degree weather for an hour or more to go tattle to the police that I stole from them.
Now I have court for second degree theft.
What the hell is going to happen???

You will be dealing with the consequences of stealing from your parents.

Whether you intended on paying your mother back or not, you used her debit card without permission. That was a pretty stupid thing to do. Not only did you commit a crime, but you had absolutely no idea what checks or other commitments your mother had already made against the money in her account, and therefore no idea whether or not your action would cause other things to bounce...therefore causing your parents all kinds of other problems.

Why did you hide your phone?

Seems like your relationship with your parents is pretty toxic.

    How old are you?

I'm 16. I used the debit card without asking because that's what I always did in the past and i thought they wouldn't care. My family makes over 100,000 a year so it's not like we are poor or anything, and in the end I gave them more money than I even took.

They just really, really, REALLY, hate me.

It is still not your right to use someone else's debit card without permission, no matter how much money they make. That's theft no matter how you slice it, and the act that you got away with it in the past doesn't make it all right.

Your boyfriend has nothing to.do with this. You are the one that used the debit card without permission. And your parents reaction to it has nothing to do with and I doubt a Judge would believe your parents hit and kicked you.

Oh BS. Your parents do NOT hate you. They may be frustrated as heck about your behavior, but they do not HATE you. They also had every right to confiscate your phone so the fact that you so cleverly hid it, explains a lot about their frustration.

You are a minor. Your parents are the boss of you. Your phone doesn't get paid for without their authorization, period...and certainly doesn't get paid for with one of their cards, without their specific authorization.

Obviously you have to date, not recognized your parent's total authority over you. The courts are going to make you clearly aware of that.
