    H1B Renewal With a Pending Domestic Violence Charge
    HI Team,

    I have been working on United states since 2012. My Visa will expire on September 16, 2015. I applied for Visa Renewal and it's under process to get receipt number. Meantime i was arrested by Dallas, Texas county police for Class C Domestic Violence assault and kept inside bar for a night. Now i am fighting the case against court to dismiss the charge. Please help me to know the consequences that will have on my H1B visa renewal process. However, My attorney is helping me to dismiss the case in Court but my next trial/hearing on September 24, 2015 which is way ahead of Visa last date in USA.

    Before my case is reached to any conclusion, will USCIS approve my H1B visa to get renewed before my visa(I94) gets expired ?

    Please let me know. i need your expert advise

    Form I-129 does not ask about criminal charges, so the issue may not come up. Still, we can't make promises about what may happen should the USCIS learn of the pending charge -- if you want reassurances you should discuss the details with an immigration lawyer.
