    Class C Misdemeanor Charge for Disorderly Conduct
    My question involves criminal law for the state of: CT

    I was making dinner for my children. My children currently live with me and do not reside with my ex. My ex comes here, without notice, and try to see about taking the children out of the house. She noticed the key does not work. She has not lived with me since April 2015 and I have been supporting the children on my own since she has not been here. I had the locks changed today and the management company was the one whom did it and told her to remove herself from the lease since he has no right being here. She tried to enter the door and noticed her key did not work. She immediately called the cops saying she lived here and goes to her parents house whenever she was heated. That was a total lie within itself since she does not live here, period. So the cops came here and no arrest was made. I have a couple of questions since this occurred:


    1) I am going for my A.A. in science, will this affect me in looking for jobs since she has done this?
    2) How will this affect me when I am going for child support and primary custodial parent since they have lived with me since April 2015?
    3) This is my first charge, ever, how can this affect my future?

    I am now facing a Class C Misdemeanor in disorderly conduct and criminal lockout since she has not lived here at all. I should probably add that in also.

    I hate it when people tell half a story and then ask us what's going to happen with their lives.

    The cops came and no arrest was made. Yet you're charged with a Class C Misdemeanor. You wanna tell us how you got there?

    My ex and I are going through a separation. She cheated on me with a mutual friend of ours. She refused to remove herself from the lease. The cop just stated I need to appear in the court tomorrow morning. He had no worries about it. So I had a promise to appear tomorrow.

    No one but you cares about who your ex cheated with but you. The police don't come, say have a nice day and then charge you with a crime, so unless and until you can fill in the rest of the story, go to court, find out what's going on and then deal with it accordingly.

    Take an attorney.

    The rest of the story is just that, she showed up here, noticed her house key didn't work, she called the cops, the cops came here and a report was filed where she was locked out of the house even though her name was still on the lease. She has not lived here since April 2015. The cops come and talk to the both of us. But, they decided not to arrest me. They just gave me a promise to appear for tomorrow and charge me with disorderly conduct and criminal lockout since she was on the lease. That's the whole story in a nutshell.

    Your basic problem starts with this: she’s on the lease. That means she has a right to possession of the premises, just like you do, unless you get a court order that says you have exclusive possession of the leased premises.That’s true even if she is currently living someplace else. If you are going through a divorce, you can ask for the court order preventing her access to the leased place in your divorce proceeding, though whether the court will grant it will depend on what evidence is presented to the court on the matter.

    Now, that still doesn’t explain why you are charged with disorderly conduct. Something happened while the cops were there to result in those charges. What was it? Did you give the cops a hard time when they got there? Were you uncooperative? What’s the full story here?

    In the end, since you are facing criminal charges, you really ought to see a criminal defense attorney for help to get the best outcome out of this.

    Well you better lawyer up. This would be the first time I've heard of nothing happening and then you get a promise to appear and end up facing criminal charges. They'll explain the charges to you when you get to court.

    No I did not. I sent my ex messages today speaking about the children and trying to find out if she was going to take the children. She didn't respond I left her alone. So she told them I was bothering her. But, I didn't how 4 messages was bothering her about the children and seeing about if she was going to get the children today or not. The officer put in his report that I am very cooperative and just trying to settle things of planning for the children so she cannot keep coming here and without notification.

    I understand the cop would have brought me down to the station and fingerprinted me and all that. And he said that himself but he did not do it.

    All you can do is appear in court. You didn't do anything or you don't kniw what you did or you don't want to tell us what you did.

    You were given a promise to appear and you didn't ask them what the charge was for or why you got the charge anyway???

    I don't know what I did actually. Figure out the family plan for the children and that's pretty much it. We had an arrangement in place and I was trying to figure out what's going on. She shows up today and finds out she was locked out of the house. She calls the cops and that was pretty much it.
