Caregiver Will Not Vacate the Premises
My question involves landlord-tenant law in the State of: California
My cousin passed away and had a friend stay with him to help with his medical needs and everyday living. The caregiver has never paid rent or contributed towards any house hold cost. caregiver has had the house raided for illegal activity twice and wrecked two of his vehicle. has had strangers move in and out as well as family without the homeowners consent. Now that my cousin has passed his house and such are left to his mom cause never married no children. all though the only beneficiary that is listed is his mom on his life insurance and retirement paper from his place of employment...how does she get them to move out. she would like to make repairs needed to put the house on the market....thank you. we have given them a letter to vacate with a 30 time limit. but don't think they will do what is asked

It may be necessary for executor to formally terminate the caregivers employment and file an unlawful detainer action.
it's a royal pain to get rid of left over guests or employees who somehow morph into " tenants " and tenants have a pile of rights in CA....a single tenant in a home occupied by single owner is a bit simpler but that may not fit your fact pattern
Either use counsel seasoned on eviction cases or consider " cash for keys"
