Petit Larceny at an AAFES Store
My question involves criminal law for the state of: New York
I was recently stopped by the loss prevention in AAFES a military on post store. I am a dependent and I was wondering whats going to happen. I know im going to get ridiculed but I deserve it. What I did was bwyond stupid and petty and I should have made better choices. This is my first offense/crime ive ever made and ever will make. I swear! Im 26 and i took 155.00 worth of make up from clinique and estee lauder. Please just help me with information I need before you judge me. If you need more information please just ask.
Re: Petit Larceny at an AAFES Store
Hire a lawyer and see if you can get an acd. If you stay out of trouble for 6 months the charge is dismissed and everything gets sealed.

If I hire a lawyer is there a way he/she can represent me in court? I ask because both of my parents are disabled and had a flood so im in TX now helping them and being their primary caretaker for the time being. Is there a way the lawyer can go to court for me or can post pone the date for me?
Re: Petit Larceny at an AAFES Store
Yes, your attorney can certainly file for either or both of those options. Perhaps you could even "attend" telephonically (see the local court rules for that).
There's no guarantee though.
Wait a sec though.
Who is actually prosecuting this?
Re: Petit Larceny at an AAFES Store
As Doggy aludes, an ACD is only available if you're being tried under NY State law. However, if this took place on a military installation, you're likely facing a federal charge the rules are different. Most likely you should consult an attorney in any event.
The exchanges do also pursue civil demands, you can expect that as well. Also expect to be banned from the exchanges if this hasn't already happened.
Re: Petit Larceny at an AAFES Store
This happened in NY. Fort Drum to be exact. I committed this on base as the AAFES store. What are the federal charges? The MP's did tell me anything other than I would be contacted about a court date. I am however currently in Texas to help take care of my parents until the end of August and was wondering if my court date is sometime in July if they could push it to the end of August or beginning of Sept.

My husband is in the military therefore im his dependent. My dad is a total disable vet and my mom is total disabled due to illness.
Re: Petit Larceny at an AAFES Store
I was thinking in civil life terms. You are generally too old to be a dependent to a parent and you are not considered a dependent typically to a spouse, merely an added deduction if you file taxes jointly.
Do you live with your husband typically? If so, make sure he notifies you immediately upon receipt of any communication from anybody regarding this. If you do not live with him you need somebody to keep an eye on your mail for you. If you miss a court date things will only get worse. I would start shopping for a lawyer now so already have one to assist you in attempting to reschedule any hearing that may be scheduled before your intended return to New York.
As flyingron spoke to; this is going to be a federal matter since it was on federal lands. You need to find a lawyer who is able to deal with the issues in federal court.
Re: Petit Larceny at an AAFES Store
Stop beating her up on the dependent thing. That is an ENTIRELY appropriate term when talking about being able to access the commissaries and exchanges.
As JK points out, you need to be watching your mail. As soon as you get something official, take it to an attorney.
