    My question involves a driver's license issued by the State of: North Carolina

    I am awaiting an implied consent case which will most certainly result in license revocation. In the meantime, while my current license is still valid, I am contemplating applying for a license in the state in which I own a house and to which I am moving at the end of next month. I'd like to avoid the revocation, reinstatement (in the current state), and reapplication (in my new state) process.

    I understand that I must comply in my new state with whatever sentence the current state decides. Right now, I don't know whether I will opt for the ignition interlock option or just go without driving for a year. Either way, I'd like to have the driver's license situation cleared up in the meantime.

    Can my current state do anything to affect this plan? Will my new state move to revoke my new license after my current state's decision? Basically, will this procedure work?

    Won't work. Even if you try this they will catch up with you.

    First, the refusal suspension is one of the things that the DLC (which NY and NC both subscribe to) requires reciprocity. If you refuse in NC, your NY license MUST be suspended.

    Second, even if it wasn't suspended under the DLC, you're still not allowed to drive in NC while suspended there, even with a valid NY license. Further, with a NC suspension active, you'll not be able to renew your NY license (it will catch up with you).

    Thanks for your reply. To clarify, I am moving to North Carolina from another state. New York is not involved at all.

    So, the worst case scenario would be that I would still have to go through the revocation and reinstatement process in North Carolina if my current state doesn't revoke until after I've made the move? I don't see anything illegal in doing this. Am I wrong? I just need to decide if it makes more sense to go through process in my current state or North Carolina.

    There are only five states that are NOT part of the DLC. Even those who are not must subscribe to the NDR and will not issue/renew to those suspended elsewhere.

    You're going to have to square yourself with NC and then do whatever your unspecified new state requires. It really doesn't matter how you try to game the ordering.
