Will an Out-of-State State Traffic Ticket Affect Unsupervised Probation
My question involves criminal law for the state of: Virginia
I am on unsupervised probation for a misdemeanor marijuana charge in VA. My license is also suspended in VA as part of that probation. I have a CA license I had at the time of sentencing. I was issued a speeding ticket (5 over in a 75) in NV. Am I under obligation to report my speeding ticket to the probation office in VA even though it is unsupervised? Will this violate my probation?
The other passenger in the car received 2 misdemeanor marijuana possession and paraphernalia charges (just a citation and a fine) and I only received the speeding ticket. Does his citation affect my probation in any way or will it come up with my speeding ticket? This occured in my car and my name is on his ticket but only as the owner of the vehicle in which the infraction occured.

A speeding ticket is not going to violate your probation. While, there are some other aspects of your incident that could cause you probation problems, it will depend on the specific conditions listed in your probation orders. For example, are you required to report any contact with law enforcement? Are you prohibited from associating with illegal drug users? Were you required to surrender your CA license? Are you required to remain within specified geographical boundaries?

As far as I am aware the only conditions were 5 years of not getting in trouble and 6 months of suspended license in VA (basically just a revocation of my driving privileges there). I still have my CA license and do not have any geographical restrictions. I don't believe there are specific restrictions on associating with known drug users or to specifically notify of law enforcement.
