    Ex-Spouse Never Took My Name Off of the Car Title
    My question involves a marriage in the state of: Missouri, and dissolution of marriage in Alaska.

    I cosigned for a loan for a vehicle with my ex-wife when we were married in 05/2012, then in 06/2012 we got a dissolution of marriage. She got the vehicle in the dissolution. Although i was told that she did, she never took my name off of the title, and therefore my name is still on the registration. She refinanced the vehicle so the loan was no longer in my name, but the vehicle is still titled to me. From what i heard the vehicle got repossessed. I tried to get ahold of her to remove my name off of the title/registration but she refuses to do so. She received some parking violations and now the DMV is trying to get me to pay them. I can prove that i don't drive the vehicle, but i still want my name removed off the title/registration.

    How do i go about doing that? I live in Ohio and she lives in Missouri. We don't keep in touch. How can i force her to take my name off or how do i get a court order for the DMV to remove my name off the title? Thank you so much

    If in fact the car was repossessed and sold by the lender, then the car is already out of your name. Did that in fact happen?

    It's not up to her to "take your name off the title."

    It was up to you to sign the title over to her, keep copies of both sides, and properly notify the DMV of the transfer.

    Did you do that?

    The car was repossessed a month ago. I'm on hold to find out if and when it'll be sold. I signed the back of the title and sent it to her in march 2014. I notified the bank and the dmv. Neither have been able to get her to do anything.

    I did not keep the copies unfortunately. She doesn't care enough to go and get the title changed over. I'm hoping the vehicle will be sold off before she can get it back. As far as taking my name off the title, can I get a court order from a judge that would tell the v to remove me from title and registration?

    I suppose that's possible but it will cost you an arm and a leg.

    You might want to wait and see what happens with the repo, then decide if you just want to defend on the parking tickets and move on.

    I called the dmv and they said that since the car was transferred to her during the divorce, she's the operator and the loan is in her name, so any tickets that hit the car, I'll be alright since I have the dissolution paper stating that the car was transferred to her.

    What type of lawyer should I hire to help me with this?

    If the order conveys title to her, then offical copies of that order might win the required points with enforcement agencies ...try before you engage counsel.

    I have no ideas how one refinances something not titled to the borrower WO a fib or two?

    With which part of "this"? The broad answer would be your divorce lawyer; but if you're speaking specifically of dealing with courts over parking tickets then it would make sense to consult a lawyer who handles traffic ticket matters in the state where the tickets were issued.

    Normally, absent some pretty huge fines, if the tickets are causing you problems (e.g., a threatened driver's license suspension, negative entries on your credit report), the most expeditious solution is to pay the tickets and to try to recover the money through the divorce court. But with the divorce court being in Alaska and neither of you being present in that state, that's a more complicated option than would ordinarily be the case.

    I am hoping that as far as the tickets go, it'll be taken care off by the decree. But as far as the titling itself goes, she refinanced the vehicle into her name, and i had resigned the title, she just never finished the retitling process apparently...so from what i'm told i have to get a lawyer in Alaska to type of a demand letter and then mail it to the special server who will then serve it to her.

    I don't think she realizes that she can't do anything with the car unless i agree to it if i'm on the title, for example selling the car or refinancing it again. i am HOPING that the car was indeed repossessed and that they have resold it because if they have, then my name will be taken off the title regardless.

    So quick update, the vehicle was repossessed and it's already gone to auction so she doesn't have it anymore. I supposed that takes care of the titling problem, since the new purchaser will receiver a repossession title and take the vehicle out of both her and I's names. She did pick up the plates about 6 weeks ago from the repo area, but never turned them in to the MO Dept of Revenue. I had my lawyer draft up the letter demanding she do this, or at least go there and take my name off of the plates. She could be doing something illegal with them, and although STL Police Dept told me that i would be covered since i don't even live there, i still don't want to be held legally liable for anything that could potentially happen. So hopefully we'll see what happens. I really don't wish this much of a headache on anyone! What do you guys think?
