Moving for Change of Venue in a Divorce and Custody Case
My question involves a child custody case from the State of: Pennsylvania
Divorce, and Custody Claimt was filed in Montgomery County back in 2014. I found out a year later that it was an improper venue when I in prose filed support then he objected. My husbands' lawyer object to venue and his request got approved by judge. I got order to transfer to Media, Delaware County. I am pro-se and I am not sure what to do. I think I should file a motion to transfer from Montgomery County to Media? Do I have to transfer Divorce too? What would be the best. On the other hand, my husband's lawyer filed a Full custody in Media, Delaware County Court. When my custody from Montgomery County Court claimt (2014) gets transferred what happens with the other claimt that was done in Media in 2015. I understand one of them should be dismissed because I cannot have two of the same.

What appears to have happened is that you file your action in the wrong county, and your ex- filed in the correct county -- or perhaps both counties were potentially proper venues but he filed first. If there is a divorce and custody case already filed in Media, then you can appear and counter-claim in that case. It would be an extremely good idea for you to get a lawyer.
