Is Severe Medical Hardship a Defense to Eviction
My question involves landlord-tenant law in the State of: CA
I am awaiting a heart / liver transplant and leased the perfect home to meet my medical needs and my twin's home.Paid every month on time with no problems. I even put a double deposit of 4300. down to get this home with possible buying after 2-3 years. I would have leased for 3 years but my prognous was not good. I had two caregivers that while hospitalized , were to pay bills and my lease.
They departed May 29,2015 back to Idaho to see family. On June 1,2015 I went to pay my lease online as usual and message said call 'customer service' which I did only to find out my caregivers had not paid the lease for April/May. I immediately contacted leasing agent and tried to resolve by paying lease for April/May with $120 penalty each and pay June, all lawyer fees ($850 approx) for $7588. Now they won't accept since I did not attend 'detainer' hearing because I did not receive notice. Anyway, I have only till Weds 6/17 to move or they auction all my stuff including all valuables.
CA law states I may get a repreive for severe medical hardship and ability to pay past rent. I meet both and my transplant doctors and regular dr's will support all that. I am having additional heart surgery within 2-3 weeks. I have never had this type of problem but want to stay where I am as this lock-out is causing grave concerns for my medical teams and am being pushed up to receive a liver very soon. I have the ability to pay my lease every month and have never caused any thing to ever be evicted. This move would also cause a greater loss as I would not have receive custody as this move is coming so quick and need to stop immediately.
Plus Sheriff was to give 7 days to voluntary move then lock-out. This was never done and was given two minutes to grab my meds ( over 24) that I only got part of. Can someone please help me for immediate help before Wednesday, June 17.

Likewise your state Bar Association, your local Legal Aide and any law schools in your area will be happy to provide referrals.
