I want to get emancipated at 15
dear anyone who is willing to help,
my mother, whom i live with, is in the navy. i recently had to move to hawaii from monterey, california because of her job. my mother and i have had many issues with eachother. recently, my mom was charged with beating me, i was put into foster care for a week, but she eventually dropped of most of the charges. i attended therapy for the last 6 months of 2005 and the first 6 months of 2006. since i moved things with my mother have only gotten worse.
she usually completly ignores me, and when she doesnt she's always yelling at me.
she comes home everyday from work in a bad mood, and goes straight to her room. the only reason she ever comes out, is for food. at the end of november i got caught shoplifting earings from the navy exchange. things have been worse ever since then. she got in trouble at work, and her master cheif hates me. my mom cant even look at me with out crying now.
things are getting worse by the day. my step dad says if i want to get put back into foster care permanently, that i need to tell her and she'll put me up for adoption. i know some people who would adopt me, but i would rather be emancipated.
my best friend's parents said i could come live with them until i graduate.
i have never met my real dad, although i do have his information, so i need advice. PLEASE. i cant take it anymore.

Get a full-time job and support yourself 100%. Then you will be emancipated.

The only emancipation statute I see for Hawaii relates to marriage:

The only state that will even consider emancipating a 15 year old is California, and for it to happen in California you'd better be either a successful child actor or a nationally recognized athlete.

I agree with the Ca. laws. You had better learn to get along with your parents. No judge in their right mind will let a 15y/o care for themselves unless they are indepently wealthy and have an adult supervision over them and their money. You mention that another family is willing to care for you. Are they also going to pay for all of your care and bills? No judge will order the parent to pay another party unless they agree to.

I got a therapist. she's great, but i have a feeling she will attempt to make me forget about the emacipation. Except, i know this is what i want. At this point, there is no point in building a relationship with my mom. She's just so depressing. She tells me that she expect's me to get pregnant soon, like i'm some sort of slut. That along with all the other put downs from everyone. I can't take it anymore, I NEED out.
I can, and do support myself [mostly]. I babysitt at least once every week and make a couple hundred dollars every month. Anything I want, I buy for myself.
Also, about what I said before, about having people who are willing to take me in until i graduate. There are actually two families.
I'm really not happy where I am. My mother thinks that my emacipation idea is just so I can go back to see my friends, but she is my problem.
Do you know where I can get the papers?
I would like do have the emancipation take place in california.
But if that is not possible, then can someone tell me how to solve my situation?

Natasha, please listen.
1.) Your state does not provide emancipation for minors, particularly not 15 year old minors, unless you have been married. NO state will allow a 15 year old to be married without parental consent.
2.) You cannot be emancipated in California, because you do not live in California. Nor will California emancipate a 15 year old except in very rare circumstances which do not apply here. The various states are not in the business of allowing someone to bypass their own state's laws.
3.) Just because you want to be emancipated, does not mean it will happen.
Emancipation is hard. It's supposed to be hard. Very, very few teens are granted legal emancipation under any circumstances. A source that I have reason to trust stated recently that out of approximately 10,000 applications for emancipation in the state of Georgia for the year 2005, 12 were granted; 9,988 were turned down. There is no reason to believe that other states are different.
Emancipation does not mean going to live with someone other than your parents. It means supporting yourself, TOTALLY. A couple hundred a month will not pay for rent, utilities, telephone, clothing, transportation, school supplies, medical care, shoes, shampoo, telephone, internet connection, etc. And without a sufficient income to pay for all of the above, not to mention a place to live that does NOT mean living with someone else, no judge will even consider emancipation.
Not being happy is not sufficient reason for a judge to emancipate you.
You need to get the idea of being emancipated out of your head, because the chance of it happening is somewhere between slim and non.

i relate to this because i am also trying to get a 15 year old emancipated. Under your circumstances it sound like you might be able to get a transfer to a different parent(legal guardian). I do believe that the only way to get emancipated at that age is to be in legal marriage.
This raises a problem though... in order for minors to get married they have to have parental consent. I believe that is the only way but i'm not possitive. There has to be certain circumstances that allow a 15 year old to get emancipated though.
I've been up for 28 hours researching so if i see something that can help i'll post it here

No, there don't. The state of California, and ONLY the state of California, will in RARE circumstances allow emancipations at that age - this is due to a couple of teenage actors with issues of having their wages mismanaged by their parents. NO other state will even consider emancipating a 15 year old for ANY reason.
