    Ticket for Parking in a Handicapped Spot With No Blue Paint, VC 22507.8(A)
    My question involves a traffic citation from the state of: California.
    I parked in a spot that does have a visible sign but the handicapped symbol on the ground is blacked out and the curb has been painted white. The line on the left hand side is white but the one on the right hand side is blue. I got a parking violation stating VC22507.8(A), am I still responsible for this ticket?

    Can't visualize what you are describing. Please post a photo of the parking spot.

    Im not sure how to post a picture :( Let me try to explain it again...

    If you are looking straight on at the parking spot, the handicapped sign is on a pole right in front. The curb is painted white, not blue. The handicapped sign that was painted on the ground is now painted over in black paint.

    There's a sign on the pole right in front of you.

    Doesn't matter if the sign on the ground is defective, the sign on the pole is still there and quite obvious from the driver's position pulling into the parking spot.

    So, yes, you are responsible for paying the ticket.

    Try showing the judge that picture and see how far you get.

    I think the OP’s question is more academic in nature.

    OP was cited for violation of CVC 22507.8. (a), which (in part) prohibits parking in an off street stall or space designated for disabled persons pursuant to CVC 22511.8.

    CVC 22511.8 says the appropriate designations for such a space must include a sign AND either of the following: (excerpting)

    (2) (A) By outlining or painting the stall or space in blue and outlining on the ground in the stall or space in white or suitable contrasting color a profile view depicting a wheelchair with occupant.

    (B) The loading and unloading area of the pavement adjacent to a parking stall or space designated for disabled persons or disabled veterans shall be marked by a border and hatched lines. The border shall be painted blue and the hatched lines shall be painted a suitable contrasting color to the parking space. Blue or white paint is preferred. In addition, within the border the words “No Parking” shall be painted in white letters no less than 12 inches high. This subparagraph applies only to parking spaces constructed on or after July 1, 2008, and painting that is done on or after July 1, 2008, or as the State Architect deems necessary when renovations, structural repair, alterations, and additions occur to existing buildings and facilities on or after July 1, 2008.

    (3) By outlining a profile view of a wheelchair with occupant in white on a blue background, of the same dimensions as in paragraph (2). The profile view shall be located so that it is visible to a traffic enforcement officer when a vehicle is properly parked in the space.

    While the sign is obviously present, neither of the other two required wheelchair symbols are painted on the ground. It would appear this parking space is not a properly marked and qualifying handicapped zone within the meaning of CVC 22507.8(a) even though the actual intent and purpose of the parking space is blatantly obvious, even to a partially blind man.

    I think the sign and B make this a legal ticket?

    It has to be everything in 2 or everything in 3.

    2 Requires the handicapped symbol to be painted in the parking space itself and any accompanying loading/unloading area be painted and marked in a certain way depending on the year ion which it was constructed or painted.

    3 Requires a handicapped symbol be painted on the ground where passing enforcement people can see it, such as behind the vehicle in a traffic area.

    Neither of these conditions have been complied with. I realize it's nitpicking and any ALJ who reviews a citation appeal is going to wonder what kind of idiot is arrogant enough to park there, appeal the citation and keep a straight face in doing so.

    As far as I'm concerned, anyone who parks in a spot that is as clearly marked as a handicapped spot as that one is, deserves everything they get whether the paint is blue or white or purple or pink.

    Although ... if the space was created prior to July 1, 2008 ...

    In my city I'd say about half of the handicapped spaces in town we cannot cite for because they do not meet the current standard of the law, and we choose not to try and guess whether spaces were painted before 7/1/2008 or not. We have noticed the property owners to repaint these spaces so the onus is now upon them.

    While common sense may say that, sadly, the law does not always allow us to act on common sense. Though in those places where we have these unenforceable spaces, I still go into the business and ask whose parked in it and why they don't have a placard. That often either spurs someone into action to move it, or, to hang their placard.
