How to Get Support Modified Due to Employment Changes or Birth of Another Child
My question involves child support in the State of: Wisconsin/Texas/Nevada.
I have been paying about $750 in child support through the state of Wisconsin (17% if I remember correctly). The mother and child have moved to Texas, and I have moved to Nevada. I am now married and have a child with my wife. Me having a wife and another child was after the child support started. For 2014 I made $61,100 at my job and I did take $8900 out of my 401k if that matters. I lost my job towards the end of April due to the company I worked for going through a restructuring/reduction. I am currently on unemployment in Nevada ($410 or so a week)
I have no contact with the mother or the child in Texas. She has changed his last name. The only reason I know she moved there and changed his name is by looking at court records in Wisconsin.
Do I have any avenue to get the child support reduced? I feel like my current family gets absolutely nothing, which doesn't seem fair to me at all. Please let me know what my best course of action may be. If there is information that I have missed that is needed please let me know. Thank you for your help!!
Re: Both Parties Moved, I Have Another Child
Your wife needs to get a job. Why haven't you enforced or gotten a visitation plan with your child who lives in Texas? You CHOSE to have another child KNOWING you had to support your first child. File a modification based on involuntary change in income. Be prepared for it be modified again when you get a job.
Re: How to Get Support Modified Due to Employment Changes or Birth of Another Child
If you want Wisconsin to modify its child support order based upon your job loss, you petition the court to modify your child support order and document your job loss and income during subsequent proceedings. If you want Wisconsin to modify your support based upon your new child, you petition the court to apply the state's serial family formula.
If you want to see your child, it would be sensible for you to seek enforcement of the visitation order at the same time.

Your first two questions are irrelevant but thanks for the info on the having to file the modification based on involuntary change in income.

I'm assuming that I can file for both the income change and because of having a 2nd child? Also, will I have to go to Wisconsin for this - or can it be done remotely? Would it ber beneficial to have the child support changed to Texas (if that's even possible)?
Re: Both Parties Moved, I Have Another Child
Actually my first two questions are NOT irrelevant if someone actually wants to be a father. Sorry. I thought that was you. Apparently, you are scum. Not seeing your child would be heartbreak for MANY actual parents -- if not all. You though don't care. I pity your child. Oh and DEFINITELY file to have the child support changed to be calculated by Texas. That would be very appropriate and worthwhile.
