    Getting a Divorce and Petitioning to Move Out of State with the Children
    My question involves a marriage in the state of: Georgia I'm wanting to get a divorce because the relationship is dead there are no feelings towards one another. We fight all the time and it makes us both miserable. I've also fallen in love with another man but the problem is the other man lives in a different state which I would love to move too but I don't know what steps to take I have children. I feel they would be better off in the state that the man I love lives in but I'm worried that I can't move there with my children because my husband won't let me what can I do?

    You would speak to an attorney and go from there.

    You're not even divorced yet - there is little chance of you being given permission to relocate the children out of state in those circumstances.

    Georgia's laws changed some time ago, and now it comes down to "best interest".

    I can promise you this - moving out of state to live with some other guy before the ink is dry isn't going to do it, outside of extenuating circumstances.

    Be prepared to explain why it's in their best interests, AND the question of why Dad shouldn't have custody. Remember you haven't even filed for divorce yet; showing the court that you don't have the best judgment in the world isn't going to help you.

    One more thing. Dad can't stop you from moving. At all. Ever.

    But he can certainly stop you from taking the children with you.
