Will CPS Remove Child if Parent Fails Drug Test for Marijuana
My question involves child abuse or neglect in the State of: California.
My son recently got injured and now cps is looking into it. I've been fully cooperative and met up with the worker which went fine. She told me they'd do a follow up, well She calls today to say I need to drug test. I told her that's absolutely fine I have no problem with that. What I didn't tell her is that I smoke marijuana (not inside and not around my son). I have never bothered to get a medicinal marijuana card and now feel as though that's something I need and intend to go get it take care of. My question is will they remove my child from me if I come up dirty for pot and don't have a medical card? I'm terrified they are going to take my son and he is my whole entire world. I'm not stoned around him and he is always well taken care of in fact my whole world revolves around being his mommy and I will be DEVISTATED to have him taken from me. Please I need info and all attornys in my area want a couple hundred dollars for a consult which I cannot afford.

How was he injured though? How did CPS get involved?
A medical card is not a guarantee that no action can be taken. Much as alcohol is legal, a parent who abuses it can end up minus their children... and the same goes for pot.
You REALLY need an attorney.

His dad went to shut a door and didn't know he standing there the door hit him and slit his forehead. It's already been established that it was an accident because it's obvious it was. I don't partake often which is why I've never gotten my card and I'm just not sure what to do

Also using pot and abusing it are two very different things. a drug test will only show if I've used or not and part of me wants to just be upfront w her before I take the test so all the cards are on the table but Idk

Yes, I'm well aware that there's a difference. My point was that it CAN be held against you.
This is why you need an attorney.
Though if it was an accident, why are they insisting you take a drug test?
