The general rule is that the home state keeps jurisdiction.
Is there some reason you want the jurisdiction changed?
Yes I pay $1400 a month which is outrageous, my son is well provided for by both of us. We both work full time and own our own homes. But it's expensive, not trying to get out of it by any means. But the 2 states are very different with respect of formulas used. I am remarried and have a new son and 2 step sons as well as my son every other w-end.
Thanks for your reply...
Thanks, you are correct My wife and her x support our 2 step sons. It's just things are tight for us because of the payment amount. I know that's life but there has to be some sort of level playing field. MASS is the worst state for CS I am told. Don't want my son to suffer but the X does pretty good...
Just didn't know if I could try to provide support under CT instead of MASS?
Did you let her move out of Mass?
She can't move out of state, with your child, unless you say it's ok.
You can try and have the traveling expenses deducted from your support. You would qualify for a "Significant change in circumstance", as she moved the child out of state. (You need a siginificant change in order to go back to court for something)
Depending on when she moved, you can try. The longer you wait, the worse your chances of winning.
We divorced and were very reasonable, shared the same attorney. I didn't fight the move because it was important for both of us to move on. CT move wasn't the worst thing, I still have an awesome relationship with my son and see him often and speak every other day. Since she won't move closer I want to pay her cost of licing in CT instead of MASS.
