    How to Find Out Who Currently Owns a Loan, in Default
    My question involves collection proceedings in the State of New Jersey

    If OC states on all 3 credit reports that my defaulted "private loan" was sold and paid by a guarantee agency and it shows a zero balance and states "PAID OFF" but yet I am being sued by a third party collection agency in the OC name as plaintiff, how can that be? Also, the servicing agency who serviced my loan says the loan was transferred to collection agency. How can I find out who truly owns the loan? OC & servicing agency both tell me to call collection agency. Could perhaps the collection agency is the true owner now and maybe also JDB who bought the loan for pennies on the dollar and is suing me under OC's name, which, wouldn't that be fraud?

    By properly responding to the lawsuit which will start the discovery period during which you can obtain all of that information from the Plaintiff.

    The summons should tell you if you have to file an Answer and what the deadline is. What does it say.

    How much are you being sued for and what court level are you being sued in?

    I am passed the discovery stage. The Plaintiff went for & received Summary Judgment & Judge was skeptical and looked directly at me and said I have 20 days to file Motion to Reconsider & I should do that. Also Judge questioned Plaintiff's attorney on why he did not answer question I asked of him "was the debt sold". He did produce an Affidavit from Plaintiff's employee stating that account has not been sold but with all the documents I provided and presented to the Court stated otherwise, (I'm thinking Robo signed). Judge even stated to Plaintiff's atty. that should he not be telling truth that it would be perjury to state otherwise and he will hold all who perjures themselves accountable. Now I have to file Motion to Reconsider. Amount is $50,000. private loan & in superior court.
