Will an Employee be a Suspect in an Employer's Fraud
My question involves criminal law for the state of: TX

the company I worked for is texas based small oil and gas investment company. I am the only accountant there. I started this job right after I graduated from college. I dont have any experience at all. Nobody in the office taught me.
The company has been investigated by FBI and SEC privately due to fraud. Here is my 3 concerns that I knew they may look into, some of them I may involved in:
    1. My boss asked me wrote check to his other company. Under the general ledger for loan payback. But I dont think that company ever loan any money to this company. He didnt pay himself at all. He used corporate credit card for his vacation and spent to his meal and his family expense.

    2. So the project we were raising about 300,000 for drilling and testing. Actually he only spent 50,000 to pay the drilling and testing. He transfer the money to operating account to pay the employee, office expense, his credit card and check to his other company. ( He is only person transfer the money. I can't. He controls all his bank account.)

    3. I heard he was still selling the project while the well has already been drilled. I dont think I am involved in this at all.

Rest of it maybe telemarket fraud on the phone. I have no idea about it. So how deep I am involved in this right now? What should I do about it? I can't quit my job since I am under my H1B working visa. Thanks a lot.

There is no way we can tell you what the future holds. We cannot investigate the company, we have essentially no facts to work with, and we have no information about the investigations, where they are targeted, or what information has been obtained by the various agencies involved in the investigations.

I suggest keeping up with your plan to transition to another company. You should also consider consulting a lawyer about what to do if you are questioned about your employer's actions, your involvement, what you know and when you knew it.
