H1B Worker's Employer is Under Federal Investigation
My company was investigated by FBI and SEC. I don't know how big trouble I am in right now. I am planning to leave the company. I am under my H1B visa right now. I don't know if I can find a company to transfer so quickly. What If I apply for community college? The deadline for fall semester is June 1. I don't know once I apply for F1 visa. I will lose my H1B immediately. I have so many stuff to deal with this summer. I can't go back home first then come back for school. I want to know when I can get F1 visa and I don't have to leave for sure. Thanks a lot.
Re: H1B Worker's Employer is Under Federal Investigation
Your best short-term option would appear to be to find another employer who can petition for a transfer. Once the USCIS accepts the new employer's petition you can start working for the new employer; although that's not a guarantee that the petition will be approved. With premium processing, you could find out very quickly if the new employer's petition was approved.
To try to change status from H1B to F1, your application must be received by the USCIS before your last day of work, and you can enroll in classes while awaiting approval -- expect the process to take four to twelve weeks. Your college of choice likely has an immigration liaison who can advise and assist you -- and it is sensible to have the advisor review your situation before submitting anything to the USCIS.
