Answering Questions About Your Immigration History
Hi all,
My husband and I are married. He is citizen and I am in OPT right now. I am applying the family based immigration and have 3 questions in the I-130, I-485 and I-864.
1. I-130 PART B (16) Has your relative ever been under immigration proceedings?
When I was 8, my uncle(he is citizen) applied the green card for my parents, my sister and me. Many years later, we got a mail saying that we have to pay a fee and provide additional documents. But at that time, my parents decided to stay in my hometown, so we ignored the mail. And few years later, we got a mail again and it's a final notice of termination of registration. It said that the record of our registration and any petition approved on our behalf and all supporting documents have been destroyed; any Department of Labor Certification has been returned to our prospective employer. In this case, should I choose no in this question?
2. I-485 PART3 (A) Have you ever applied for permanent resident status in the U.S.?
I applied the green card lottery (electronic diversity visa)for 2016 and I have not been selected. Should I choose yes or no?
3. I-864
My husband haven't worked over 1 years, so he doesn't have tax return yet. But his expected salary in the contract for this year will be 3 times higher than 125% of poverty line. In this case, how much asset does he need to provide in the form?

Your "home town" being in your nation of origin? If you never entered the U.S., and the petition was deemed abandoned based upon your failure to provide the required fee and documents, that would not constitute "immigration proceedings".

Applying for the DV lottery is not the same thing as applying for permanent residency and, based on that act alone, the answer is "no".

He needs to provide truthful information on the form. He may need a cosponsor.
