You may make a complaint with the police if you wish. But they likely won’t do anything about it. Assuming that she consents to what her boyfriend is doing, it appears that he is not committing any crime in Pennsylvania. It is not a crime in Pennsylvania for a person to have what it calls “indecent contact” with someone under age 16 so long as the person is less than 4 years older and the activity is consensual. Indecent contact means “Any touching of the sexual or other intimate parts of the person for the purpose of arousing or gratifying sexual desire, in either person.” 18 PA. Cons. Stat. § 3101. Indeed, it is not a crime for a person to have sexual intercourse with someone under age 16 so long as the person is less than 4 years older and the sexual intercourse is consensual. 18 PA Cons. Stat. § 3122.1. In short, it appears that in Pennsylvania he can touch her anywhere he likes and he can even have sex with her so long as she consents and it would not be a crime since he is less than 4 years older than she is.
