What Are the Chances of a Shoplifting Prosecution if the Police Aren't Called
My question involves criminal law for the state of: Nevada

    Hello!
About 6 weeks ago, I was accused of petty larceny in Nevada. The LP agent took me into the back, had me sign a civil demand notice form (I received my demand a few days later and paid it quickly), and had me sign a Summons Program form through the local police department which stated I would be receiving a court summons in the mail. He did not call the police because of how cooperative I was. I've been checking online with the court and the court hasn't filed a complaint yet. How likely is it that I got lucky and will not have to go to court? When can I expect a summons? How likely is it that I might not get one? Any advice would help.

Re: It's Been 6 Weeks and the Court Has No Information About My Shoplifting Case
Generally, if they do not call the cops and have you arrested on the spot, it doesn't go beyond the civil demand and you being banned from the store in question. That doesn't mean that it cannot still happen, it just means that its less likely at this point.

Re: When/if Will I Get a Summons for Shoplifting
You can be charged anytime between right now and whenever the statute of limitations expires on your offense. After 6 weeks, it is possible that either the incident was never forwarded to a prosecutor for charges or the prosecutor declined to file charges…but, nobody but the prosecutor can tell you for sure. You can contact the prosecutor's office directly and inquire about your incident (if the prosecutor never got a report on the incident or declined charges, they are not going to file because you called and reminded them).

Are all of your threads about the same act of theft, or are you now talking about multiple incidents?

You only need to ask a question once. The answer doesn't change.

There's your answer. The LP agent TOLD you that you are being prosecuted and will receive a summons in the mail. Six weeks to have the charge not showing up is a bit on the long side, but it sometimes does take weeks for charges to show up in the court system.

YOU had better be proactive and contact the court to find out if a summons was sent. If you don't do that, expect to be pulled over one day and taken to jail for a warrant you didn't know you had. It happens all the time - notices get lost in the mail, whatever - and then you'll be sitting in jail, coming up with bail money, etc. and swearing up and down that you never got anything from the court. Your life will become very complicated.

Again, if I were you, I'd be calling the court to make sure I didn't miss something, because the LP agent didn't have you sign a summons and tell you you'd be getting a court date just for fun. He likely is filing on you.
