Will a Lawsuit Show Up in a Background Check
My question involves labor and employment law for the state of: NJ
It has been over a week since I completed my background check consent form. My questions are:
1. Why is it taking so long?
2. Will a previous lawsuit for a car accident that was settled outside of court be in the background check?
3. If the lawsuit is in the background check, will an employer look at it negatively?
4. What happens if they can't verify some of my employment due to business closing or if former employer doesn't remember me?

That will depend on the nature and extent of the background check. For a routine background check, a civil lawsuit that was settled without entry of a judgment is not the sort of thing they will search for or locate. For more complex background checks, such as those involving national security, they can find all sorts of surprising information.

That will depend on whether the accident or lawsuit are arguably relevant to your employment, as well as the policies of the employer.
