Charged With MIP While on Probation for Marijuana Possession
My question involves juvenile law in the State of: South Carolina
To begin, I received a Minor in Possession charge along with possession of a fake I.D. as well as, I think it was called, Attempting to Purchase Alcohol Underage or something of that sort. These charges resulted in a stay overnight in jail. All of the charges were expunged through an Alcohol Education class. This occurred when I was 17 years old. Now, at 19 I received a SPMJ(Simple Possession of Marijuana) charge in January which will be expunged on June 29 upon the successful completion of a second drug test. Unfortunately, I was at a party this past weekend and received another MIP for alcohol.
1. Will the MIP be considered a third offense with the SPMJ being the second?
2. Will the MIP be considered a second offense to the one I received two years ago, being a different category than SPMJ?
3. What consequences should I expect?
4. Should I get a lawyer?
Re: Charged With MIP While on Probation for Marijuana Possession
Yes, you should get a lawyer. Your bad choices are likely to land you with convictions for both your marijuana possession and the new MIP charge.
I'll let somebody else try to parse the various statutes for you, if they're interested. It's a discussion I think you should be having with your lawyer.
