Does Handicapped Parking Have to Be Marked in Blue
I recently parked in the right most parking spot late in the evening, not knowing that it was/is a handicap parking spot. When I went to work the next day there was not a citation, or ticket but a note written on a piece of cardboard box saying this is a handicapped spot and to not park there again; apparently from another tenant. However the other handicapped spots are clearly marked with signs and blue paint.

    My question:

Could I get a ticket/towed if I park in this spot? By the way I live in Denver.

Thanks for any and all advice!

If you know those are handicapped spots, you'd be foolish (and an butthole) to park with them expecting to weasel out of any repercussions based on some signage technicality. Those laws are to protect those people who might unknowingly park in a poorly marked spot.

Denver is a bad place to be flaunting the regs. They have a vigilante disabled parking enforcement system that lets just about anybody write such tickets. There's no requirement for any particular signage, though using signage approved by the city manager indicates consent by a property owner to have the police (or whomever) come in and enforce such parking. Of course, the owner is free to not complain about people writing such tickets even without the signage

So the answer is you're on very thin ice. You can be cited here.

To the extent that it's private property, they can mark the lot any way that they choose -- the issue becomes whether their markings are sufficient to allow them to legally remove your vehicle or to have the police issue a ticket. The space is obviously meant for handicapped persons, so obviously you should stop parking there simply by virtue of your having a basic level of decency or humanity.

If you choose to park there again, I suggest researching state and local laws and regulations pertaining to towing from private parking lots and the proper marking of handicapped parking spaces.

Let’s start with a key question: in what state do you live? There are at least two states with a city named Denver, and it may make a very big difference which state it is.

Actually it is more basic than that. If you are a resident, compliance with their rules is part of your lease. It likely spells out parking restrictions. If you agreed to the markings, they can tow. If you keep parking there, they can start an eviction for causing a disturbance.

The statements I gave were specific to Denver, Colorado:

    1. There's no requirement for any specific signage.
    2. The city provides a provision for ANYBODY to write handicapped tickets on a volunteer basis.

Don't do it. You're not going to weasel out of your misbehavior.

    For Denver, Colorado,
    Quote:

Quoting Sec. 54-485(f). Parking for persons with mobility impairment.
    (f) The owner of private property available for public use may install signs prescribed by the city traffic engineer identifying parking spaces designed to specifications of the city traffic engineer and reserved for use by the disabled. Such installation shall be a waiver of any objection the owner may assert concerning enforcement of this section by such police officers, and such officers are hereby authorized and empowered to enforce this section of the Code.

For a person parked in a private parking lot to receive a ticket that is enforceable by the city, the signage must comply with the traffic engineer's requirements. (If you can find those requirements on Denver's website, you're doing better than I am.)

That's not how I read the statement Mr. K. This section says nothing about what is REQUIRED before enforcing the handicapped parking statute. It only says that if the owner wants he MAY install such approved signs and by doing so he waives any objection he might have of the cops and the vigilante enforcers from coming on to issue tickets. It doesn't say he can't decline to object and let them do so anyhow.

It states what is required before the designated handicapped space can be enforced by the city. The "vigilante enforcers" are agents of the city. If the spot doesn't meet the requirements, there will be no (valid) municipal ticket for improperly parking in the spot -- officers are empowered to enforce the parking ordinance only if the requirements are met. However, as of yet I have not actually found the rules, so... who knows what they require? Also, private property owners have remedies over improper parking so, assuming their lots are properly posted, even if the marking isn't sufficient for the city's purposes the property owner may be able to have the car towed.
