Does a No Resale Policy for Event Tickets Apply When Sale is for Less Than Face Value
Nevada.
I bought a ticket from 3 people in a casino to a show at showtime for under face value. I was approached asked for I.D. Asked if I knew the people I was with.I was asked if I exchanged money for a ticket they say the camera saw exchanged.I told them no but they say they have it on camera. I asked what was the problem. They kept looking to the eye in the sky to verify what they were accusing us of. The gentleman I was with said the ticket was sold for under the face value. They threatened to take us under arrest and press this further. We were asked if we had been drinking and we were forced to leave the property. I have the ticket .I have the time and date of the alleged crime. I am out $100. The other gentleman is out $185. And $85. They took my drivers license info . Was this legal. Do I have any recourse. If they saw everything ,they saw a 100 dollar bill. 04/11/2015
Re: Buying a Ticket in Nevada to a Sold Out Show for Under Face Value
You have not even established you purchased a real scalped ticket. Generally speaking, they are permitted to remove and trespass warn anyone they wish. The scalpers were likely charged if video evidence shows cash in excess changing hands, contrary to your assertion.
12.38.020 - Ticket scalping prohibited.
Any person who, without the written permission of the owner, operator or manager of the property on which an entertainment or sporting event is to be held or is being held, sells a ticket of admission to the entertainment or sporting event at a price which is in excess of the price that is printed or endorsed upon the ticket is guilty of a misdemeanor.
Re: Buying a Ticket in Nevada to a Sold Out Show for Under Face Value
It was a real ticket if that is what you mean. I have it.They have a no resale policy on premises I was told.Is that legal. I was not warned .It was let's call it a night ....goodbye. If I went to question them any further ,I would have been held in their office for a while .I knew if I questioned their little authority ,they were going to ruin my night. So I left.I didn't know the legality of what crime they were implying that I did.
Re: Buying a Ticket in Nevada to a Sold Out Show for Under Face Value
A no resale policy on site is legal. Otherwise the casino shows would be sold out and it full of scalpers. How long do you think you would be there, if you went to an auto parts store and tried to sell the parts of your junker to customer who was about to lay down $500 for replacement parts?
Re: Buying a Ticket in Nevada to a Sold Out Show for Under Face Value
This was not a scalp ,it was under face value. I understand they don't want any transfers. No resale policies are legal. There was maybe 3 transfers of tickets that I saw. Nobody there was under 60 for Christ sakes. It was a Steeley Dan Show!Over zealous square badges who couldn't get on a real Police Dept.
Re: Buying a Ticket in Nevada to a Sold Out Show for Under Face Value
The basic problem is that they saw the ticket sale and they assumed it was likely a scalping situation. They don't have to believe you when you say you paid less than full value. Moreover, even if they did believe that, they may still suspect the ticket seller is a scalper trying to off load the last of his/her stock before the show starts to at least get something for the ticket. They don’t don't want to encourage scalpers and some places will strictly enforce the non resale policy to keep them away as much as possible.
Re: Buying a Ticket in Nevada to a Sold Out Show for Under Face Value
If they saw the sale ,they saw a $100 bill. I was about to shake hands with the people and go in and see the show with them.I was sitting with them.I understand their situation ,I just think it would have been very easy to get get off with a warning .A group of three of them gathered together acting real official. They were dealing with people over 60!Can you say overzealous prosecution. LOL. Real proud of themselves! Locker room talk....Victory! That's alright ,when you like someplace you tell 3 people ,when you don't like something you tell 17.I will never go to this venue to see Steeley Dan on Flamingo again.I will tell 100.

how did you buy it from 3 people?
were they accusing the seller of being a scalper or violating a no resale on premises rule?
as it stands, not sure anything you have done is illegal. The seller is the one committing the crime or rule violation typically.
as to being out the money; if what the seller did was illegal or violated a rule, that is where you go to get your money back. If there was in fact no violation, then I suspect they ejected you from the premises for some other reason. If the had no valid justification to eject you, seek compensation from those that caused your damages.
what doesn't make any sense is if this was a scalping issue or a violation of a no resale on premises rule, why didn't they take the ticket?
