    My question involves criminal law for the state of: New Jersey

    Hello. First, to give a little, and very brief, back story on the case itself, yesterday, after having been stopped in town by a police officer who was investigating a case,
    me and two friends ended up being questioned, searched, and taken into custody (bear in mind that we are all under the age of 18, and we are all sober). After having reviewed various affairs, i was informed that we were to be, and most likely will be, charged with underage possession of (unopened) alcohol. I would like advice on how to proceed with this case. The implications of, even such a minute charge such as this, are devastating to college applications, which are right around the corner. I have never been in any sort of trouble with the law. Is a lawyer necessary or beneficial? Is it even at all possible to have these charges not appear, or be expunged, by the time of college admissions (in the fall)? I would appreciate some info into this matter. Thank You.

    Yes, an attorney would be beneficial. The arrest and charges (if/when filed) are public records and will show up on a background check. There is no way you will be able to have this charge adjudicated and subsequently expunged before fall.

    An attorney is a good idea if and when you get charged. I wouldn't run out and retain an attorney just yet but have one or two standing by.

    The fact that the police say you will be charged really doesn't mean much. It will be the prosecutor that makes that call based on the facts.

    You haven't shared what exactly happened but if 3 people all have the same potential control of unopened alcohol then who was really in control. That can lead to reasonable doubt. It's call constructive possession.
