    Child Support Papers Do Not Reflect My Son's Name Change
    My question involves name change laws in the State of: Texas

    My son's dad ran off after he found out I was pregnant. I gave birth without him there. My son's original birth cettificate shows the nsme I gave him. The state did find dad & set up child support with dad & I agreeing to using his name which is what shows on the support papers. Things went bad between dad & I. I insisted that my son's name be a merge of both original & dad's so we did as a legal counselor suggested & filled out the birth certificate name change, having a notary public stamp it & send to the correct state department. The legal counselor said nothing about how to get the child support papers amended. I've been to child support court several times yet only in front of a judge two times, dad absent of course. Because dad was not there, the judge said he couldn't amend it even with the new birth certificate as proof. Dad showed up long enough to destroy the original & new BCs then off to prison.
    How do I get this fixed? I don't dare move out of this school district because of the name/BC/CS issue! Help!

    It's easy enough to order a copy of your child's birth certificate.

    It's not clear what the issue is. You appear to be stating that you successfully amended the child's birth certificate to reflect his name change. If dad is subject to a child support order for your child, that order continues to apply even if the child's name has been changed. If dad is in prison, dad's not in a position to bring a petition to modify custody.

    I agree, and if dad destroyed the child's Birth Certificate then just go down to the office of vital records and get another copy. They probably will charge you something for it, but they are easy to replace.
