How Much Support Will You Pay After a Change of Custody
My question involves child support in the State of: Georgia
I have had custody of my daughter, but now she wants to go live with her mother. She is of age to choose, and her mother is not unfit. Therefore, she will likely get custody. My concern is how much support I will have to pay. Much of what I have (my car, home, etc.) was built around having to take care of three children. I have two children with my current wife, one of whom has a severe heart condition (he is four and has had four surgeries with two more planned before he is 10). Though my wife works, she has to take off when he has his surgeries, and I am the primary supplier of our household. Will any of that affect the child support?

Its not outside the realm of possibility that a judge might consider a deviation in child support based on the fact that you have a child at home with severe medical problems. However its absolutely not guaranteed.

You can estimate child support using the state's child support calculator.

Georgia changed that law several years ago. Best interests of the child are looked at before the court will give consent to a change in custody. Children no longer get to 'choose' as such.

However, they are still allowed to express their preference and have it taken into consideration as part of that "best interests" decision...so I really don't know how much the change in the law has actually impacted judge's decision making processes. When we were actually comparing the old and new laws a few years back the change was not a strong as we originally thought.
