    Can Visitation be Modified Based on a Parent's Living Situation
    My question involves a child custody case from the State of: Massachusetts

    Hi, I am wondering what bearing the living situation has when a custodial parent is trying to modify visitations. For example, My childrens mother is stating my living situation is unfit for overnights. I live with my parents, I have one bedroom with one bed. When I have my children I let them sleep in my bed and I sleep on the couch in the living room. Their ages are 5, boy and 7, girl. Is there any law stating this is unfit? They have been living like this for a couple years now and has never been a concern for their mother until now.

    Other than the sleeping arrangements, the house is a loving, clean, home. My parents are loved by the children and vise versa. I believe I am worrying too much, Just nervous about losing overnight weekend visits with my children.

    Do you actually have a court order?

    If you do, the next time Mom makes a threat just smile at her sweetly and say "Okey dokey".

    Your living situation, as described, doesn't come anywhere close to being unsuitable or unfit.

    I absolutely agree...however, as the children get older it would probably be wise to get an air mattress so they no longer have to share a bed.
