How to Change a Child's Name While His Father is in Prison
My question involves name change laws in the State of: Texas
    Hello,
My first time posting on this site and I am beyond frustrated....:( all I've been hearing is I need a lawyer
which I cannot afford at this time as much as I want to its just not possible. I have twins with a man who is
in prison for 6 years due to hurting one of the twins (injury to a child with intent-known)....and I have a protective order against him
however I would like to get rid of his last name and the twins have mine how can I do that without a lawyer and would a judge most likely grant it??

    Thanks for the help

Once you read the link that Doggie has posted, if you don't understand what it said enough to do what you need to do to accomplish what you want?

    You need an attorney

Thanks I read what doggie had posted and I 100% understand it .

however before I shell out almost 600$ (on filing fees and serving him) would it most likely be granted??

There are never any guarantees, but in your situation I'd imagine you'd have a better chance than many... if not most.

ETA: If he's locked up for the next few years, you can save up for at least an initial consultation with a lawyer. It doesn't have to be done right now.

Someone stole the crystal ball and the insurance company has yet to replace it with a new, calibrated one.

Have dad's rights been terminated by the court? It may not be so but and dry. I've seen some strange things before.

That's a good point, CC. I think I'd be pushing the State for that one.

I do want full custody that's where the lawyer stuff comes in I've been told I can't do it myself quotes I've been given 4,000-7,000$ as a single mother that's obviously not in my budget also been told that I need a man willing to "adopt" though my mother more than willing to accept his "responsibilities" the protective order says he can't have contact be near us blah blah but legally he's still responsible and I don't want him to be

What's the current custody situation? Do you have a court order?

You're not wed to Dad, right? Is paternity established legally?

Let's see if we can help you a bit more.

Sole legal and physical custody has nothing to do with the termination of dad's rights. Have dad's rights been terminated by the court?
