What Happens to Unpaid Restitution When Probation Ends
I am brand new to the forum & don't see "New Post" button anywhere on the forum but, if I am on Social Security Disability and my probation will end in two short months and they are taking money out of my check for restitution, will the garnishment end automatically or will I have to "Petition/Request" for it to stop? I owe $180,000 and don't foresee it ever being paid with or without demand. It's not like I can just stop paying like other respondents. Please Advise.
Re: Balance Of Restitution After Discharge From Probation
You can ask the court clerk if the garnishment order will end when probation expires.
Even if it does, the victim can continue to try to collect the money you owe.
Re: Balance of Restitution After Discharge from Probation
Unfortunately someone in my old company stole that ridiculously massive amount of money but I was not contacted about it until three years later by the victim. Of course the ex-employee was long gone and I was left holding the bag [so to speak]. I wish I had the benefit of the money, I would have just returned it but I was just stupid and trusting. Furthermore, after reading numerous posts I have come to understand that the money will be owed but payment can not be enforced unless civil court gets involved after probation is completed. By the way, Probation was easy. I just followed every rule to the letter. I got through perfectly. I have never been in a position to pay the money my ex employee schemed. Even though I feel bad; you can't get blood from a turnip. However, if I ever get an ability to pay, I will gladly pay with no hesitation.
