How to Get a Custody Order
My question involves a child custody case from the State of: Colorado. I need to know what it takes to get an order established. My son is almost 9months old. There have been no problems until the last few days. Now i feel i have to bring the law into my situation to ensure my equal rights. His mother and i were never married. She lived with me for awhile. I have no problem supporting him financially. After three days of missed "appointments" to see him i went to where she lives and was told to go away i had to right to be there and the cops would be called. So i left and called the police myself. They conducted a welfare check and reported everything ok. She has threatened to leave the state "as i have no rights to parenting, because we were never married" according to her. So I would like something asap that prevents her from leaving with him. Something that sets up a schedule where i can see him now(well as soon as possible. I miss him so much) and then some thing permanent. Also on a side note can i stand outside the house where she is staying. On the sidewalk or street. I want her to know I'm serious and will not accept this treatment and am not backing down

If your paternity is established (i.e., you executed an acknowledgment of paternity and are named as the father on the child's birth certificate), file a custody (parental responsibilities) action in the county where the child is domiciled. If not, file a paternity action in that county and ask for a custody and visitation order as part of the resolution of the paternity case.

That's possibly the most idiotic idea I've seen in years. Do you have any clue what can happen if you do that? Do you understand that you can essentially hand her all she needs to convince the court that relocating the child is in the child's best interest?

As of this second, and in accordance with Colorado law, you have no more rights to that child than I do.

Dogmatique is correct. That idea is silly and counter-productive, and could even result in your being accused of stalking.

Really? Your plan is to plant yourself outside of her home? That's scary as hell. NOT a good idea - it just shows the lengths you're willing to go to to harass her and makes you come across as a psycho.
