    Do Grandparents Have to Pay Child Support if Their Minor Child Has a Baby
    My question involves juvenile law in the State of: SC
    Is this the right forum for question about 14 year old kids having sex and getting pregnant? The legalities involved?

    I have a 14 year old son. He and his 14 year old girlfriend had sex almost weeks ago. She now claims she is pregnant. Her mom says she is having baby. They want to know how and when we are going to help monetarily. Are there any laws In SC regarding statutory rape, minors having sex and are we the parents financially responsible for this baby? The mother is already talking about going to DSS, child support and take me and my husband t court. Do I need an attorney? I AM CLUELESS. Hoping for some friendly advice.

    You very much should get an attorney. Both you and your son are in big trouble.

    Since your son is equally young as the girl, there is no statutory rape (or similar law) that makes this on its face illegal in South Carolina. One person needs to be under 16 and the other over 18 for the law to apply there.

    Your son is obligated to support his child and ultimately will be ordered to pay child support. Grandparents are not parents and do not pay child support.

    I do not agree. Not in SC and certainly not federally. You might want to check 42 USC 666(a)(18)

    (18) Enforcement of orders against paternal or maternal grandparents.— Procedures under which, at the State’s option, any child support order enforced under this part with respect to a child of minor parents, if the custodial parent of such child is receiving assistance under the State program under part A of this subchapter, shall be enforceable, jointly and severally, against the parents of the noncustodial parent of such child.

    And then the same text pretty much occurs in 63-17-350 of the South Carolina Children's Code

    When a child is born to parents, either or both of whom are unmarried and under eighteen years of age, the Child Support Enforcement Division of the State Department of Social Services may pursue support and maintenance of that child from one or both of the child's maternal and paternal grandparents as long as the parent of the child is under eighteen years of age.

    Thank God my son got through all of his teenage years a virgin because there is no way in hell I'd be paying for my child's child. It's spring time, he needs a lawn mover and he needs to start mowing laws and power washing houses. I think McDonalds starts hiring at 15.

    If you don't make him get a job and support his child, he will be expecting you to pay for every mistake he makes for the rest of his life. He is old enough to decide he wanted to do what he did, now he has to suffer the consequences until the child is 18.
