    Underage Drinking on Spring Break
    My question involves criminal law for the state of: Florida

    Hi everyone! I'll be going down to Destin, FL on Saturday for spring break. I've heard people talking about arrests on the beach, and I was just wondering what cops are actually allowed to do. I know open containers is a biggie, but are cops legally allowed to come up and question you about water bottles, bubba kegs, etc?

    They are permitted to arrest you, charge you, make you appear in court and entirely destroy the purpose you went to college for by giving you a ticket for which you were found guilty in a court of law.

    If a police officer has articulable reasonable suspicion that a person has, is or is about to commit a violation of the law, that officer can detain the person and investigate that suspicion. A reasonable suspicion is a fairly low standard. So, in answer to your specific question, yes, if a cop sees a person who reasonably might be underage who has containers that might reasonable contain an alcoholic beverage, he or she can investigate that. Even just the smell of alcohol about your person would be enough to charge you with underage possession/consumption.

    Bottom line is…it’s not worth the risk. Just wait a couple of years until you can legally drink.
