    How to Serve a Discovery Request
    My question involves traffic court in the State of: Ohio

    Good morning everyone, a couple days ago I called the prosecutor's office becauase I was wondering whether I had to mail my Discovery request or if I could personally give it to either the court clerk of take ti to the prosecutor's office. His response was: Are you the defendant? I said yes... He immediately said to me, I am sorry but I cannot provide legal advise to you becauase you are the defendant. I then told him that I was not seeking advise, I just wanted to know how I ciould serve my discovery letter, since the first one had been ignored.

    Is there anything else that I can do at this point? I still don't have a defense because the evidence has not being provided to me. Anyone have any advice?

    I requested the discovery request for a speeding citation. 53 MPH on a 35 MPH zone, the officer said he paced me, but the ticket was written for 45 MPH on a 35 MPH.

    See Traffic Rule 11. You would need to comply with Criminal Rule 16, and serve your demand on the prosecutor's office. You should file a copy and proof of service with the court.
