    Not only can this happen, as he found out, but I've actually done the very same thing, with the very same charges before.

    I'm in LE as an officer for city A; I live in city B, where I have no LE authority. One day, while preparing to enter the freeway in city B, I needed to move over a lane in dense rush hour traffic. It appeared that another car was slowing up to "let me in." I merged over. Apparently I read the other driver wrong, because as soon as I started changing lanes he floored it and laid on his horn. He then swerved out of the lane, flew past me, and cut me off with something like inches to spare. He then slammed hard on his brakes. I slammed on mine; he accelerated and quickly slammed on his brakes again, before leaving the lane to go straight (instead of getting on the freeway.)

    I immediately called the police dept. of city B, told them what had transpired, and stated that I would sign a statement and charges if they charged him. I informed them that I was following him, but had lost him. They took my name and told me an officer would get back to me.

    Later, an officer asked me to come in and make a statement, which I did. He ran it past the prosecutor, who directed him to charge the subject with menacing. The subject showed up to the police station with an attorney he'd retained and was issued a criminal citation for menacing. It was later disposed of in mayor's court; I'm not sure what became of it, as I was never summoned to appear as a witness. I'm guessing he pled guilty or no contest and was fined.

    jd1985, you did not witness the events in question. Your friend and his wife may think the elements of the crime were not met, but, apparently, the complaining party was able to convince the police who forwarded a complaint to the prosecutor and a judge who believed that there was sufficient cause to issue an arrest warrant. Your friend should consult legal counsel ASAP.
