What is the Punishment for Burglary
My question involves criminal law for the state of: Texas
There is a wide range of penalties for burglary 2nd degree. Does judge look at the circumstances in the crime. Does behavior during time on bail affect the severity of the penalty? Is there anything that my relative can do while out on bail to hopefully avoid jail time?

Only in the negative! You don't get any credit for acting like a law abiding citizen after committing a crime, you are expected to act that way all the time. But if you get into other trouble while waiting for results on the first crime you have a good chance that you will get increased penalty for the original conviction.
Re: How is Penalty Determined by Judge
There's no such thing as "second degree" burglary in Texas. I suspect what he's really facing is a charge of burglary which is a second degree felony.
A second degree felony can result in imprisonment of two to twenty years. Even if he doesn't end up in jail, he'll be under community supervision.
A second degree felony can result in a fine of up to $10,000.
The most important thing he can do for his situation at this point is get a lawyer. This is serious stuff.
