    Burglary Charges Due to a Fingerprint Match
    My question involves criminal law for the state of: Texas
    My relative was charged with burglary 2nd degree , 1st offense. He was out on bail and months later he was arrested for attempted burglary. Fingerprints matched from 6 months prior to his arrest for other charge. Police said there was a warrant out for arrest. Why is this just coming out? So now I feel that he will get a stiffer penalty. Is there a chance that he can get probation or deferred adjudication. I don't want him to go to jail. I believe he is scared straight.

    Well, if that was his first arrest his fingerprints were not in "the system"'until he was booked. Once they were in the system they apparently matched prints from an open crime investigation. That association is not instantaneous.

    Your belief and the application of law are 2 different things. Apparently, he knocked off 2 places somewhat close together. The second may have resulted in the prints being forwarded to the FBI for a match or reconstruction before he was booked, charged and sentenced on the first crime. Now he will be doubly scared straight.

    With the databases these days he may have had his prints in the system even if he hadn't been previously arrested. IAFIS has prints from the military and the federal government employees as well.
