Sexting a Minor Who Responded to a Craigslist Personal Ad
My question involves criminal law for the state of: Wisconsin
I posted an ad on Craigslist, Casual Encounters, Man looking for a Woman. Got a response, and we exchanged face pics via e-mail. She looked college age. We continued to e-mail and exchanged cell numbers to plan a get together. She asked for a penis pic, I texted one to her. Then today I called her to plan a meet and her FATHER answered. He infpormed me she is only 14!! I had no idea. He asked me if it's my common practice to send penis pics tro minors. I told him I had no idea she was under 18. He said the courts will figure it out and that I should never call her number again. I told I wouldn't and apoligized and hung up. Have I broken the law?????

Most likely this is a scam, and he will demand money to keep it out of court. Do not communicate with them any more. If you hear from the police, then call a lawyer.
On another note, stop sending dick pics to people you don't know.

Can the authorities prove that the person who initially accessed the recipient email account and saw the porn was a minor? How do we know that the first person to access the account was not some adult who later showed the pics to a minor?

His question was, "Have I broken the law?", not "Can they prove I did it and will I go to jail?".

I'm no lawyer but I do know the personals section also makes people "agree" that they are over 18 before viewing, so I would think a good lawyer can prove that the op is not at fault for this, and had reason enough to believe the girl was an adult, since she had to agree that she was in order to see or respond to his ad. Just my view on it

There's more than just the eventual possibility of going to jail. The burden of proof for an ARREST is only "probable cause". Whether or not there's a conviction after that arrest, let's be VERY clear that even JUST an arrest for a charge of this nature can result in major consequences in one's life.

You can be arrested and have your life ruined. And you may or may not be found guily if the case goes to trial. If you continue not actually knowing someone well enough to know what their age is and not just what they tell you, you will end up in jail one day or worse.
