Theft Charges Over Equipment Stolen From My Employer
My question involves criminal law for the state of: Texas
I found out today that I have a warrant for theft $500-$1500
This is most likely from my previous employer, in which my brother stole a piece of equipment to use on a side job. When I found out that he allegedly stole this he told me that he did not and I made him get a receipt from the distributor. Which he did and I have a copy of
He said that when he picked up the part he told them to put it under a company that he was using to get parts for our side jobs, but the lady made a mistake and put it under the employer accusing him of stealing because he usually went in there in their uniform.
He said he went in and made them switch it to the correct company and he paid cash for the part, then the original employer was credited for the part.
I now have a warrant and am unable to pull up any charges, how should I move forward
Also the price of that part was $296, but they are charging me $500-$1500

so why would YOU have a warrant if your brother was the one that was the person involved in the actual activity that brought this about?
The story is related in much more detail in another thread.

It's time to lawyer up.

There may be more than one part involved, or they may be applying retail price as opposed to wholesale price; the answer should be in the police report.
Re: Theft Charges Over Equipment Stolen From My Employer
I am unable to find a police report
This all went down several months ago and I am just now being charged, is there a chance this will be dismissed due to lack of evidence to charge me?

If you are being charged, a police report should exist somewhere.

Can't say. As previously mentioned, it is time to lawyer up.
Re: Theft Charges Over Equipment Stolen From My Employer
The police report may not be available on an active investigation. Just because the warrant didn't show up when renewing your license doesn't mean there wasn't one. It may have simply not been issued yet or there are times warrants do not end up being discoverable to all that inquire.
You can either do as others suggested and lawyer up, do nothing and hope the bail bondsman was reacting to a situation that has now been cleared or walk into the local police department and say; hey, I heard you were looking for me.
Option 2 and 3 means you will likely go to jail if there is actuslly a warrant. Option one may allow you to prepare bail/ bond before being arrested so your stay time is minimized.

I have already spoken with the bondsman and am going with him to turn myself in on Friday, I will be booked then bonded out. Then after that I suppose ill go get a copy of the police report and then talk to a lawyer. I just do not have money to pay for one in a prolonged case
