ok grandparent wants me to sign my rights over and tells me if i do there will be no more child support and they will drop the arrears as well. is this true?? can the state come after me for child support as well if i sign my rights over??:confused:

If the child has received any state-funded services it's not likely to drop any arrearage that accrues to the state.

But if I was paying child support why would the state still give assistance? And why would the assistance be my debt? Shouldn't it be hers?

We have no way of knowing whether or not your ex- received public assistance. If she did, it was because she qualified for assistance in excess of what the state could recover from your support obligation or because you failed to live up to your duty to pay support such that she had to obtain assistance -- she can't feed the kids with child support arrears. If she did not, it's not an issue.

If your child support is to be applied to your ex's public assistance and you choose not to pay your support as ordered, some or all of your accrued arrears will be owed to the state. The amount you owe doesn't change -- just the party to whom it is owed.

If the child receives or received Medicaid, you may also owe for the medical care the child received.

When a child is receiving Medicaid, medical support can be made payable to the state, but the primary responsibility is going to pertain to the premiums, not to any additional expenses that might fall under the medical support provision of a child support order.

Yes, she was receiving support. Particularly since she has two other children that are not mine. Should that be my debt as well? I paid consistently for years. Got behind for being out of work for several months intermittently. Its the interest and fees that have ballooned the amount to something that is unreasonable.

They aren't holding you responsible for her other children. They're holding you responsible for your child. Interest and fees are what happens when you get behind.
