Because if she is beyond the 2 year point, she can likely stay in spite of a divorce as long as she makes it through the joint hearing as long as she does not go into a court spouting the same whining drivel about how all he does is lay around and play video games on a court record and that is why she wants a divorce.

As long as the marriage is legit - and again, having a family kind of makes that a no-brainer - she should have no problems in the future as it pertains to her status. Even if her residency is conditional.

Which gets back to the heart of the original issue which was basically "I do not plan on leaving the States, if I can create a situation that is manageable.", for which I informed her that her husband in part or in concert with others, guaranteed to provide for her support in the US at 125% of the poverty level, whether she is divorced or not, as long as she can stay on the right side of her visa, which is why I was asking the question before you became so defensive. So we can just drop the matter I will jump straight to the basics. At 2 years, your green card needs spousal assistance and documentation to prove it was a good faith relationship. You then get another green card. At this point you can divorce and standing by yourself apply for a removal of conditions of the green card at the 5 year point. Then you can proceed to try and become a citizen or renew at expiration. You must follow immigration laws with respect to keeping your record clean.
