    Where in the Constitution does one find the right to go potty? I doubt there is a law anywhere that requires store LP to allow a shoplifter to go to the potty.

    And what would you suggest that a reward or settlement would be for something as petty as this? I mean, you would have to spend time from work, trips to the court house, pay an attorney, fuel and possibly pay a parking lot while at court. For what, no money but Costco to change there policy to let criminals use the bathroom?

    Nowhere in the Costco LP manual is there a policy that they are not to let shoplifters use the bathroom. Most state's merchant detention statutes call for the shoplifter to be detained in a "reasonable manner." "Reasonable" is for the court and jury to determine.

    Please name even one medical condition for which a single instance of delayed urination will cause death.

    Please name a legal basis for a lawsuit to sue for something that didn't happen. (She didn't die - she didn't become ill. She had wet pants for the duration of the trip home - uncomfortable and embarrassing, but hardly life threatening.)

    We're not talking about either state actors or a punishment. We're also not talking about a potty accident that occurred while the shoplifter was in custody.

    Most companies do not REQUIRE that someone be allowed to use the restroom, particularly if there are fears on the part of loss prevention that the subject may attempt to flee, hurt themselves, or hurt others.

    They made a judgment call in this situation. I'm not going to second guess them based upon one side's recollection after the fact.

    If you feel the the store security acted outside of what is reasonable you can complain to store mangement or corporate office. This wont change the charges or outcome of court case though
